Nailvory Terms of Use

Last updated: 21 September 2026

These Terms of Use ("Terms") are a contract between you and Mário Otruba, an individual developer established in the Slovak Republic ("Nailvory", "we", "us"; contact details at the end). They govern the Nailvory iOS app and everything it does ("Service"). By installing or using the app you agree to these Terms. If you do not agree, do not use the app.

1. What Nailvory is

Nailvory generates images of nail designs with artificial intelligence, from the options you choose, text you type, sketches you draw, reference images you add and, optionally, a photo of your hand. The images are previews to help you decide and to show a nail technician. They are not a promise that a salon can reproduce them, and they are not professional advice of any kind.

2. Who can use it

You must be at least 16 years old, or have the permission of a parent or guardian, to create an account or buy a subscription. Nailvory is not directed at children under 13.

3. Accounts

The app creates an anonymous account on first launch. You may optionally sign in with Apple or Google so your library and subscription follow you to other devices; the anonymous account is then merged into the signed-in one. You are responsible for what happens under your account. You can delete your account and all of its data at any time in Settings → Privacy → Delete my data.

4. Free designs, subscriptions and payments

5. Your content and our content

6. Acceptable use

You agree not to: upload photos of people other than yourself without their permission; upload or request sexual, violent, hateful, or otherwise unlawful content; use the Service to harass anyone or to infringe anyone's rights; attempt to bypass the free allowance, usage limits or security measures; reverse engineer, scrape or resell the Service; or use Output in a misleading way, for example presenting it as a real photograph of work done by a specific salon. Requests are filtered automatically and may be refused. We may suspend or terminate accounts that break these rules.

7. Availability and changes

The Service depends on third-party AI providers and may be slow or unavailable at times. Generation may occasionally fail; failed generations are not charged against your allowance. We may change, add or remove features, and we may discontinue the Service with reasonable notice. If we discontinue it while you have a paid period left, Apple's refund rules apply.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law we make no warranties, express or implied, including fitness for a particular purpose, and we do not warrant that Output will be accurate, achievable at a salon, free of defects or suitable for any purpose. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for intentional misconduct, gross negligence or death or personal injury, or your statutory rights as a consumer in your country of residence.

10. Termination

You can stop using the app at any time and delete your account in Settings. We may suspend or terminate your access if you materially breach these Terms. Sections 5, 8, 9 and 12 survive termination.

11. Apple

These Terms are between you and us only, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price to you; to the maximum extent permitted by law Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection claims, and for the investigation, defence and settlement of any claim that the app infringes a third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law and disputes

These Terms are governed by the laws of the Slovak Republic, without prejudice to mandatory consumer-protection rules of the country where you live. Before starting any formal proceedings, please contact us; most problems can be solved by email within a few days.

13. Changes to these Terms

We may update these Terms. The date at the top shows the latest version. Material changes will be shown in the app or announced on this page before they take effect; continuing to use the Service after that means you accept the new Terms.
